Terms of Business

Definitions:

The Customer or You is the person placing the order, paying for the order and or consuming food or drink purchased within the order.

Us, We  or the company refers to French Food Hampers.com

General:

Some products contain nuts, egg, milk and other allergens. Refer to product packaging for further information. If you are unsure of any of the ingredients, do not consume the product. Additionally please be aware some of the cheese is unpasteurised soft cheese, particularly if you pregnant.

All contents have been described through the contents list and photographic props such as plates, glasses, cutlery and other utensils are not included unless stated.

Goods are intended to have a shelf-life of at least 5 days from point of despatch for most perishable goods (reduced to 2 days for fruit, bread and other bakery items), therefore please ensure that the delivery is scheduled mindful of this timeframe.

As our products are often handmade all weights given are approximate only and packaging may vary from those shown. In the event of if, for any reason beyond our reasonable control, we are unable to supply a particular item, we reserve the right to substitute goods or packaging of equal quality and value. Wine vintages and labels may vary from those shown.

All items featured on our website are subject to availability.

Items containing alcohol can only be ordered by and delivered to persons aged 18 and over. The product images shown on the website are intended for presentation purposes only. Hampers and their contents are configured for safe and secure transit using suitable packaging methods.

Delivery:

Whilst we will do our utmost to ensure deliveries are made on the requested date, please note that such dates serve as estimates only and cannot be guaranteed in any way.

Any claim for non-delivery of any Goods shall be notified in writing by the Customer to the us within 5 days of the intended delivery date. Any claim for damage to any Goods shall be notified in writing by the Customer to us within 24 hours of delivery.

Regardless of how the order is communicated to French Food Hampers (on-line, fax, e-mail, telephone-call etc.), it is the customer’s responsibility to ensure that all order and delivery details are correct at least two working days prior to despatch.

French Food Hampers reserves the right to impose a surcharge retrospectively for any balance arising from the selection of an incorrect delivery zone, e.g. UK Mainland option selected for a Scottish Highlands or UK Offshore destination. If the customer is in any doubt as to the correct delivery option for their chosen destination then it is their responsibility to consult French Food Hampers prior to placement of the order.

Our guarantee is limited to delivering to the building, not individual recipients.

We will use best endeavours to deliver to the building/address specified as the delivery address, not to individual recipients.

French Food Hampers do not accept any responsibility for any loss, damage, delay or other disruption in supply and deliveries brought about as a result of any of the following:

  • inaccurate or incomplete delivery address details;
  • delayed payment (cleared funds);
  • delayed order receipt.
  • or other factors beyond French Food Hamper’s reasonable control

French Food Hampers reserve the right to charge the Customer an additional fee for carriage, handling charges or unusable content in the event of a failed delivery caused by the supply of an incorrect or incomplete delivery address by the Customer.

Ordering:

All goods remain the property of French Food Hampers until they have been paid for in full (cleared funds).

Orders are not accepted until the point of despatch. For the avoidance of doubt, placing an order on the website will be deemed an offer to purchase

Prices quoted are subject to change without notice. VAT or other sales taxes may be applied when applicable.

No order which has been accepted by the Company may be cancelled by the Customer except with the agreement in writing of the Company and in terms that the Customer shall indemnify the Company in full against all loss (including loss of profit), cost (including the costs of all labour and materials used), damages, charges and expenses incurred by the Company as a result of cancellation.

Data

By providing your personal data in order to place an order you grant consent for the company or use and process your personal data for the purpose of processing your order in accordance with the Data Protection Act 1998.

Returns policy:

We operate a returns policy for order cancellation. You are allowed a 14 day cooling off period from the date of delivery. This means that we will refund the total cost of the product and the standard delivery charges (excludes any Saturday or timed delivery slot surcharges) to you, if you choose to cancel your order for any reason, provided you comply with the below:

  • You notify us of your cancellation in writing to French Food Hampers within 14 days of delivery. By return, we will confirm the returns delivery address.
  • The goods remain unused and component parts are unopened.
  • You or the recipient retain and take reasonable care of the goods and package the goods to be returned securely in the original packaging.
  • You are responsible for returning the goods to us at your own cost, and including a printout of your invoice or your order number.
  • Refunds will be issued upon safe receipt of the item. Refunds will be made via the original payment method.

If you think your wine has corked. The bottle must be returned to us immediately with a minimum of 5/6 (five sixths) of the wine inside and with the original cork in place. We will send the bottle and its contents to the wine producer. They will test the wine and decide if a replacement is to be provided. The decision of the wine producer is final.

Perishable and personalised items are not returnable and are not subject to this returns policy.

Exceptions:

If your order contains any of the following items we will be unable to refund your order (including postage & packaging) once it has been delivered:

  • Fresh items (including cheese, meat, fish, fruit or flowers)
  • Tailor-made or personalised goods

Force Majeure:

The Company shall not be liable for any failure in the performance of any of its obligations under this Agreement caused by factors outside its control.

Law and jurisdiction:

This agreement shall be governed by English law.
